Terms of Service
Welcome to Apple & Loom! “We,” “us,” and “our” refer to Apple & Loom. Apple & Loom operates this store and website, including all related information, content, features, tools, products, and services, to provide you, the customer, with a curated shopping experience (the “Services”). Apple & Loom is powered by Shopify. These Terms of Service, together with any policies referenced here (the “Terms”), describe your rights and responsibilities when you use the Services. They include important information such as warranty disclaimers, limitations of liability, and (if adopted) dispute-resolution terms. By visiting, interacting with, or using the Services, you agree to these Terms and our Privacy Policy (appleandloom.com/policies/privacy-policy). If you do not agree, do not use the Services.
1. Access and Account
By agreeing to these Terms, you represent that you are at least the age of majority in your state of residence, and you consent to allow any minor dependents to use the Services on devices you own or manage. You may be asked to provide information such as your email, billing, payment, and shipping details, and you represent that this information is correct, current, and complete. You are responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to anyone else.
2. Our Products
We make every effort to represent our products accurately. However, colors and product appearance may differ from how they appear on your screen due to your device and its settings. Because our items are handmade and hand block-printed in small batches, slight variations in print and color are natural characteristics of the process, not defects. We do not warrant that any product’s appearance or quality will meet your expectations or match the images exactly. Product descriptions may change at any time, and we may discontinue any product or limit quantities at our discretion.
3. Orders
When you place an order, you are making an offer to purchase. We may accept or decline any order at our discretion, and your order is not accepted until we confirm it; we must receive and process payment before acceptance. Please review your order carefully before submitting — we may be unable to accommodate cancellation requests after an order is accepted (see our Cancellation Policy and Shipping & Returns Policy at appleandloom.com/policies/refund-policy). Your purchases are for personal or household use only and not for commercial resale or export.
4. Prices and Billing
Prices, discounts, and promotions may change without notice; the price charged is the price in effect when the order is placed, as shown in your order confirmation. Unless stated otherwise, posted prices do not include taxes, shipping, or handling. You agree to provide current, complete, and accurate purchase and payment information, and you represent that you are authorized to use the payment method provided and will pay all charges incurred, including shipping and applicable taxes.
5. Shipping, Delivery, and Events Beyond Our Control
All delivery times are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, weather, or other events outside our control. Once we transfer products to the carrier, title and risk of loss pass to you. We are not responsible for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, carrier disruptions, labor issues, or supply-chain interruptions.
6. Product Safety and Proper Use
Our products are children’s textiles intended to be used only as described, and with appropriate adult supervision. By purchasing, you agree to the following:
-
Not sleepwear. Our loungewear and cover-ups are everyday apparel; they are not sleepwear and are not intended, tested, or certified for use as children’s sleepwear or pajamas.
-
Safe sleep. In line with pediatric safe-sleep guidance (AAP), keep soft items such as quilts and blankets out of cribs and sleep spaces for babies under 12 months; use them only for supervised, awake moments.
-
Small parts. Some items include small components (for example, natural coconut-shell buttons). Keep loose or detached parts away from infants and young children, and inspect items before each use.
-
Follow the labels. Please follow the age guidance, care instructions, and any warnings on the product and its labels. Do not use a damaged item.
-
Natural materials. Our products use natural fibers, dyes, and materials; if your child has sensitivities or allergies, please review materials before use.
To the fullest extent permitted by law, you assume responsibility for selecting products appropriate for your child and for using and supervising them safely.
7. Intellectual Property
The Services — including all trademarks, brand elements, text, images, graphics, product reviews, video, audio, and the design, selection, and arrangement of them — are owned by Apple & Loom, its affiliates, or licensors and are protected by intellectual-property laws. These Terms permit personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display or perform, republish, download, store, or transmit any material from the Services without our prior written consent. Apple & Loom’s names, logos, and designs are our trademarks and may not be used without permission. All rights not expressly granted are reserved.
8. Optional Third-Party Tools
We may provide access to third-party tools “as is” and “as available” without warranties of any kind, and we have no liability arising from your use of them. Your use of optional tools is at your own risk, and you should review the relevant third party’s terms. New features added in the future are also subject to these Terms.
9. Third-Party Links
The Services may link to third-party websites or content we do not control. We are not responsible for their content or accuracy, and accessing them is at your own risk. Please review third parties’ policies before transacting with them; questions about third-party products and services should be directed to the third party.
10. Relationship with Shopify
Apple & Loom is powered by Shopify, but any sales and purchases you make in our store are made directly with Apple & Loom. You acknowledge that Shopify is not responsible for any aspect of the sale between you and Apple & Loom, including any injury, damage, or loss resulting from purchased products, and you release Shopify and its affiliates from claims arising from your purchases and transactions with us.
11. Reviews, Feedback, and User Content
If you submit reviews, comments, photos, ideas, or other content (“Feedback”) — including by tagging us or using our hashtags on social media — you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display it for any purpose, including commercial use (such as on our website, emails, and social channels). You represent that you own or have all rights to your Feedback, that it does not violate anyone’s rights, and that it contains nothing unlawful, misleading, or harmful. If your content includes an image of a child, you confirm that you are the child’s parent or legal guardian and consent to our use of that image. We are not obligated to keep Feedback confidential, to compensate you for it, or to respond to it, and we may remove content at our discretion.
12. Promotions, Contests, and Giveaways
From time to time we run promotions, contests, and giveaways, including on social media platforms such as Instagram. Each promotion may have its own official rules, which control if they conflict with these Terms. Promotions are intended for adults who meet the stated eligibility requirements. Our promotions are not sponsored, endorsed, administered by, or associated with Instagram or any other platform on which they run.
13. Errors, Inaccuracies, and Omissions
Occasionally the Services may contain typographical errors, inaccuracies, or omissions relating to descriptions, pricing, promotions, shipping charges, transit times, or availability. We may correct any errors and change or update information, or cancel orders, at any time without prior notice (including after you submit your order) if any information is inaccurate.
14. Prohibited Uses
You may use the Services for lawful purposes only. You may not use the Services for any unlawful or malicious purpose; to violate any laws; to infringe intellectual-property rights; to harass, abuse, or harm any person; to transmit false or misleading information or spam; to impersonate others; to upload viruses or malicious code; to reproduce, resell, or exploit any part of the Services; to collect others’ personal information; or to interfere with or circumvent the security features of the Services. We may suspend or terminate access for any violation.
15. Automated Agents
If you use or deploy any software agent to access or interact with the Services, that agent must identify itself as an agent in its requests, must not conceal that it is an agent or mimic human behavior to evade detection, must answer truthfully whether interactions are automated, and must not bypass measures we use to control automated access. We may limit or block agent access by technical or other means.
16. Termination
We may terminate these Terms or your access to the Services at any time, at our discretion and without notice, and you will remain liable for all amounts due through the date of termination. Provisions that by their nature should survive termination will survive, including Intellectual Property, Feedback, Product Safety, Disclaimer of Warranties, Limitation of Liability, Indemnification, Dispute Resolution, and Governing Law.
17. Disclaimer of Warranties
Information on the Services is provided for general information only; we do not warrant its accuracy, completeness, or usefulness, and any reliance is at your own risk.
Except as expressly stated by Apple & Loom, the services and all products are provided ‘as is’ and ‘as available’ without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement. We do not warrant that the services will be uninterrupted, timely, secure, or error-free. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.
18. Limitation of Liability
To the fullest extent permitted by law, Apple & Loom and its partners, directors, officers, employees, affiliates, agents, contractors, service providers, and licensors (and those of Shopify) will not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, lost revenue, lost data, or replacement costs, arising from your use of the services or any product, whether based in contract, tort, strict liability, or otherwise, even if advised of the possibility. Where liability cannot be excluded, it is limited to the amount you paid for the product giving rise to the claim.
19. Indemnification
You agree to indemnify, defend, and hold harmless Apple & Loom, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys’ fees, arising out of (1) your breach of these Terms or the documents they incorporate, (2) your violation of any law or third-party right, or (3) your access to or use of the Services. We may control the defense of any indemnified claim at your expense, and you agree to cooperate.
20. Dispute Resolution; Binding Arbitration and Class-Action Waiver
Except where prohibited by law, any dispute arising out of or relating to these Terms or the Services will be resolved by binding, individual arbitration rather than in court, and you and Apple & Loom waive the right to a jury trial and to participate in a class or representative action. Either party may bring an individual claim in small-claims court. Before starting arbitration, the parties will attempt to resolve the dispute informally by written notice.
21. Severability
If any provision of these Terms is found unlawful, void, or unenforceable, it will be enforced to the fullest extent permitted, and the remaining provisions will remain in full force and effect.
22. Waiver; Entire Agreement
Our failure to enforce any right or provision is not a waiver. These Terms and any policies posted by us constitute the entire agreement between you and us and supersede any prior agreements. Any ambiguities will not be construed against the drafting party.
23. Assignment
You may not assign or transfer these Terms or your rights and obligations without our prior written consent, and any attempt to do so is void. We may assign these Terms and our rights and obligations without restriction.
24. Governing Law and Venue
These Terms and any separate agreements by which we provide Services are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You and Apple & Loom consent to the exclusive jurisdiction and venue of the state and federal courts located in Alameda County, California, for any dispute not subject to arbitration.
25. Changes to These Terms
You can review the most current version of these Terms on this page at any time. We may update or replace any part of these Terms by posting changes to our website; material changes will be effective as described in our notice, and your continued use of the Services after changes are posted constitutes acceptance.
